Melbourne Cake Studio Terms & Conditions

Welcome to Melbourne Cake Studio. By using our website and placing an order with us, you agree to the following terms and conditions.

1. Order Placement

  • Orders must be placed through our website or by contacting us directly.
  • It is the customers responsibility to ensure the information on the invoice is exactly as agreed and we are informed of any spelling errors or design discrepancy immediately. Deposit or full payment of the invoice is a confirmation that the invoice has been read and is correct.
  • A 50% deposit is required to reserve your event date and is non-refundable. The remaining balance must be paid fourteen (14) days prior to delivery or can be paid on pickup.
  • If an order is placed within fourteen (14) days of due date, cakes being collected require the 50% deposit is expected within 24 hours of the invoice being issued and cakes being delivered require the total amount paid within 24 hours of the invoice being issued.
  • Orders are only confirmed once the deposit has been received. If your deposit is not paid in a timely manner, we reserve the right to cancel your order.
  • If the customer does not accept the finished product upon collection or delivery where we have delivered a product that is an accurate interpretation of what is on the invoice the customer is still responsible to pay the full amount of the order. Even if the custom chooses to not to receive the goods they are required to pay the full amount and if they don’t legal action will be taken.
  • If for some reason the item is not an accurate interpretation of what has been invoiced and there has been no correspondence to the contrary the customer can choose not to collect the product but the deposit WILL NOT be refunded. Remaining amount will be decided on a case by case basis.
  • Any quotes provided are only valid for one month from the date of issuance. Prices, availability, and terms are subject to change thereafter.
  • Once an invoice has been issued and the deposit paid, preparation begins. Because of this, any changes in size, style, or flavours of the cake cannot be guaranteed and may be subject to additional charges.

2. Pricing and Payment

  • All prices are listed in AUD and are inclusive of GST.
  • We accept payment via credit card, PayPal, cash, and bank transfer.
  • If paying the final amount by internet transfer, the funds need to be cleared into our account 2 days BEFORE the product leaves the premises.

3. Cancellations and Refunds

  • If you would like to cancel your order, your deposit will not be refunded. At the discretion of management and dependent on the circumstances, a credit note may be issued minus an admin fee equal to 20% of the total cost of the order.
  • If you cancel your order within 14 days of the delivery or collection date, no credit will be issued, and any outstanding balances will be due.
  • Please note that any credit notes issued are done so as a goodwill gesture and at the discretion of management.

4. Delivery and Pickup

  • We offer delivery services to selected areas in Melbourne. Delivery charges are based on the distance from the store and the day of the week. Delivery is subject to availability.
  • It is your responsibility to provide accurate delivery information. We are not responsible for any delays or missed deliveries due to incorrect information.
  • If collecting the product, it is your responsibility to collect the cake on the date requested within our business hours. Late pickups will incur a fee and are subject to availability.
  • It is the customer’s responsibility to check the state of the product before leaving the premises. Once the item has been collected, the customer has accepted the item as is and is responsible for ensuring that the product reaches its destination safely and is stored as per our instructions to achieve the best results for taste and quality, and to avoid any damage.
  • If a third party will be collecting the cake on the customer’s behalf, this party will be given all appropriate information that would have been provided to the customer. The same conditions apply as if the customer were collecting the cake themselves.

5. Product Quality

  • We strive to ensure our cakes meet the highest quality standards. If you are not satisfied with your order, please contact us immediately.
  • We reserve the right to refuse any items that are provided by an outside source, such as toys or flowers. If accepted, we will place them for an additional fee. You acknowledge that these items are not food products and may contain pesticides, insects, dirt, or other contaminants.
  • Please note that all our cakes are handmade by skilled decorators, which means no two cakes will ever be exactly the same. Variations may occur due to different decorators, ingredients, tools, or seasonal availability of decorations. While we always aim to replicate the agreed design as closely as possible, customers acknowledge that minor differences may occur and that exact replication of reference images cannot be guaranteed.

6. Hire

  • A security deposit/bond is required for all equipment hires and must be paid in full prior to collection or delivery. Bond amounts will vary depending on the item being hired. If the bond is not paid by the required time, Melbourne Cake Studio reserves the right to refuse release of the hired item and cancel the hire booking. In such circumstances, any hire fee already paid will be retained and is non-refundable.
  • Hired equipment is supplied for a maximum 5-day hire period, unless otherwise agreed in writing. If the equipment is not returned by the agreed return date, additional hire fees may be charged for each day the item remains overdue. Melbourne Cake Studio also reserves the right to recover any reasonable costs incurred as a result of the late return, including the cost of sourcing a replacement item or reimbursing another customer affected by the item’s unavailability.
  • All hired equipment must be returned in the same condition in which it was supplied, subject to fair wear and tear. Where hired equipment is returned damaged but is capable of being repaired or salvaged, Melbourne Cake Studio may retain all or part of the bond to cover the reasonable costs of repair, including labour, materials, and time spent restoring the item. If the cost of repair exceeds the bond amount, the customer remains liable for the balance.
  • If equipment is lost, not returned, or returned damaged beyond reasonable repair, the customer is liable for the full replacement cost of the item, plus any associated freight, sourcing, administrative, and other reasonable costs incurred by Melbourne Cake Studio as a result of the item being unavailable, less any bond retained.

7. Allergies and Dietary Requirements

  • Please inform us of any allergies or dietary requirements when placing your order.
  • While we always strive to avoid cross-contamination with any allergens, we cannot guarantee that our products are completely free from traces of allergens such as nuts, gluten, dairy, or other common allergens.
  • Melbourne Cake Studio is not liable for any allergic reactions that may occur. It is the customer’s responsibility to communicate any serious allergies or dietary concerns before placing an order.

8. Intellectual Property

  • All content on our website, including images, designs, and text, is the property of Melbourne Cake Studio and is protected by intellectual property laws.

9. Governing Law

  • These terms and conditions are governed by the laws of Victoria, Australia.

10. Changes to Terms & Conditions

We reserve the right to update these terms and conditions at any time. Any changes will be posted on this page with the updated date.
